Terms and Conditions of Sale

1. Agreement These Terms and Conditions ("Agreement") govern the sale of products by Avantis Canada ("Company", "we", "us") to the customer ("Customer", "you"). By placing an order with Avantis Canada, you agree to be bound by these terms.
2. All Sales Are Final Please review your order carefully. Avantis Canada operates under a strict No Return Policy. All sales of mobility scooters, parts, and accessories are final. We do not accept returns or exchanges for change of mind, incorrect size selection, or color preference once the product has been shipped or picked up.
3. Payment Terms All orders must be paid in full prior to shipping. We accept major credit cards, debit cards, and other payment methods as indicated at checkout. Title to the goods passes to the Customer upon full payment.
4. Pricing and Availability All prices are listed in Canadian Dollars (CAD) and are subject to change without notice. We reserve the right to correct pricing errors. In the event of a pricing error, we will notify you and you will have the option to proceed at the correct price or cancel the order.
5. Limitation of Liability By purchasing and using this product, the Customer agrees that Avantis Canada shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising out of the use, misuse, or inability to use the product. This limitation of liability explicitly includes, but is not limited to:

Personal injury, bodily harm, or death resulting from accidents, falls, collisions, or operator error.

Property damage to the Customer's vehicle or third-party property.

Damages resulting from road conditions, weather, or traffic.

Damages resulting from failure to wear appropriate safety gear (e.g., helmets).

Actions, negligence, or misconduct of third parties or other drivers.
6. Assumption of Risk and Safety The Customer acknowledges that operating a mobility scooter involves inherent risks, including the risk of accidents and injury. The Customer voluntarily assumes all such risks.

Operator Responsibility: The Customer is solely responsible for the safe operation of the scooter, including adhering to all local traffic laws, speed limits, and pedestrian regulations.

Misuse: Avantis Canada is not responsible for injuries or damages caused by stunt riding, racing, off-road use (unless specified for the model), overloading the vehicle, or modifying the speed/motor settings.
7. Indemnification The Customer agrees to indemnify, defend, and hold harmless Avantis Canada, its officers, directors, employees, and agents from any and all claims, liabilities, damages, and expenses (including legal fees) arising from:

The Customer's misuse of the product.

Violation of any laws or rights of a third party (e.g., if the Customer injures a pedestrian).

Any accident involving the product, regardless of fault.
8. Regulatory Compliance (Canada Approved) Avantis Canada mobility scooters are designed and imported to meet applicable Canadian safety and mobility standards. While our units are "Canada Approved" for their intended class of mobility aid:

It is the Customer's responsibility to verify local municipal bylaws regarding the use of mobility scooters on sidewalks, bike lanes, or public roads.

Avantis Canada is not liable for fines or legal penalties incurred by the Customer for improper use of the vehicle in restricted areas.
